Welcome to **Fridge to Frame**, operated by **Forward Alpha LLC**. These Terms of Service ("Terms") govern your access to and use of the Fridge to Frame mobile application (the "App") and related services. By accessing or using the App, you agree to be bound by these Terms.

## 1. Eligibility

Fridge to Frame is rated for ages **4+** in the App Store. The App is designed for family use to transform children's artwork into photorealistic images.

**For Users Under 13:** If you are under 13 years old, you must have your parent or legal guardian create and manage your account. Parents or guardians are responsible for supervising app usage and ensuring compliance with these Terms.

By using the App, you represent and warrant that you either (a) are at least 13 years old and have the legal capacity to enter into these Terms, or (b) are using the App with parental consent and supervision.

## 2. Account Registration

To access certain features, you may need to create an account. You agree to:

- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your account credentials
- Not share your account or allow others to access your account
- Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

## 3. App Functionality

Fridge to Frame allows you to upload images of children's drawings and transform them into photorealistic images using AI technology powered by Google Gemini and other third-party AI providers.

### Permitted Uses:

- Upload original artwork and drawings
- Transform images using our AI technology
- Save, manage, and delete your transformations
- Share generated images

### Prohibited Uses:

- Upload images that infringe on intellectual property rights
- Use the App for any unlawful purpose
- Attempt to reverse-engineer or manipulate the AI features
- Upload inappropriate, offensive, or harmful content

## 4. Subscriptions and Payments

### Subscription Tiers:

- **Free Plan ($0):** 3 transformations per month with local device storage only. Images include watermark.
- **Starter Plan ($4.99/month or $49.99/year):** 10 transformations per month with cloud sync, backup, and watermark-free images.
- **Creator Plan ($6.99/month or $69.99/year):** 30 transformations per month with cloud sync, backup, watermark-free images, and priority support.
- **Unlimited Plan ($29.99/month or $179.99/year):** Unlimited transformations with cloud sync, backup, watermark-free images, and priority support.

### Credit Packages (One-Time Purchases):

As an alternative to subscriptions, you can purchase credit packages for one-time use. Credits never expire and can be used alongside subscription limits.

- **5 Credits:** $4.99 (~$1.00 per credit)
- **15 Credits:** $9.99 (~$0.67 per credit)
- **30 Credits:** $14.99 (~$0.50 per credit) - Best Value

**Important:** All payments are processed securely through the Apple App Store and managed by RevenueCat. You can manage your subscription and cancel anytime through your Apple ID account settings.

We do not offer refunds for partial subscription periods unless required by law. If you cancel, you will continue to have access to paid features until the end of your billing period.

## 5. User Content and Ownership

You retain full ownership of any images you upload to the App. By uploading content, you grant Forward Alpha LLC a limited, worldwide, non-exclusive license to:

- Process your images using our AI technology
- Store your images in accordance with your subscription tier
- Display your transformations within the App

**We do not claim ownership of your content.** We will not use your uploaded images for AI training, marketing, or any other purpose without your explicit consent.

## 6. AI-Generated Content

AI transformations are produced using third-party AI technology (Google Gemini Imagen 3). Results may vary and are not guaranteed to be perfect or suitable for all purposes. We are not responsible for:

- Unintended or unexpected AI outputs
- Variations in quality or style
- AI-generated content that may be considered offensive or inappropriate

You are responsible for reviewing AI outputs before sharing or using them.

## 7. Data and Privacy

Your use of the App is also governed by our [Privacy Policy](/content/privacy/index.html), which explains how we collect, use, and safeguard your personal information.

## 8. Intellectual Property

The App's design, code, branding, and all associated intellectual property belong to Forward Alpha LLC. You may not:

- Copy, modify, or distribute the App or its content
- Create derivative works based on the App
- Use our trademarks or branding without permission

Exception: You own the rights to your AI-generated transformations and may use them as you wish.

## 9. Account Termination

We may suspend or terminate your account if you:

- Violate these Terms
- Misuse App features or attempt to circumvent limitations
- Engage in fraudulent or illegal activities

Upon termination, your access to cloud-synced data may be removed. Data stored locally on your device will remain accessible.

## 10. Disclaimers

Fridge to Frame is provided **"as is"** and **"as available."** We make no warranties or guarantees about:

- The accuracy or quality of AI transformations
- Uninterrupted or error-free service availability
- Compatibility with all devices or operating systems
- Third-party AI service performance

You use the App at your own risk.

## 11. Limitation of Liability

To the maximum extent permitted by law, Forward Alpha LLC shall not be liable for:

- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Issues arising from third-party AI services
- Device damage or data corruption

Our total liability is limited to the amount you paid for the App in the 12 months preceding any claim.

## 12. Indemnification

You agree to defend, indemnify, and hold harmless Forward Alpha LLC from any claims, damages, or expenses arising from:

- Your use of the App
- Your violation of these Terms
- Your infringement of any third-party rights

## 13. Changes to Terms

We may update these Terms from time to time. Changes become effective when posted to the App or our website. We will notify you of material changes via:

- In-app notification
- Email to your registered address

Continued use of the App after changes indicates your acceptance of the updated Terms.

## 14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

## 15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

## 16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forward Alpha LLC regarding the App.
